Specialty Litigation and Program Practice

Bartlett represents the Emergency Medical Services of numerous Fire Departments, including the City of New York and the County of Suffolk. We are regularly called upon to defend both basic and advanced life support providers in all manner of litigation throughout the five boroughs of the City of New York and the County of Suffolk.  These claims range from negligent emergency medical care, late transport, refusal of medical assistance and violations of EMS protocols. We robustly defend these agencies under the doctrine of governmental immunity and have successfully moved to dismiss many of these cases based not only on the doctrine of governmental immunity but as well on the quality of the medical care provided by the emergency medical services providers.  

Bartlett represents the Prison Health Service of the City of New York, as well as the Prison Health Service of the County of Suffolk.  As a consequence, we are regularly called upon to interface with the State Commission on Correction.  This executive branch agency is mandated by law to investigate all claims involving alleged abuse, neglect and death of inmates incarcerated within the State prison system throughout New York State.  In addition, such allegations of abuse, neglect and death often engender wrongful death actions which sound essentially in alleged medical malpractice.  We successfully defend these claims as well.  

 

The firm also represents the Patrolman Benevolent Associations of virtually all of the police agencies within the County of Westchester and exclusively all of the agencies in the County of Rockland.  In that regard, Bartlett regularly advises the Benevolent Association Boards of Directors with respect to labor relation matters and other matters.  We successfully negotiate collective bargaining agreements and represent each of the members of service with respect to grievances based on unfair labor practices and the like.  Our attorneys regularly appear before PERB and as well as local municipalities adjudicatory bodies.  We also regularly provide counsel to various volunteer fire department Benevolent Associations throughout Nassau and Suffolk County.
