On the first day of trial, the Court entered a dismissal with prejudice for lack of subject matter jurisdiction. The Plaintiff was a mitigation company that had furnished services after Tropical Storm Eta on November 8, 2020. The lawsuit was filed in 2022. The trial Court concluded that the Assignment of Benefits was void and unenforceable based on a new District Court decision in 2024. This is the third trial, in a row, that Marybeth and Jorge have won this year. Complete victory for our insurance carrier client. Great job to our team!
