Our client, a highway and road contractor, was sued when plaintiff fell into a road opening while walking in Kings County, New York.  Though our client had performed work on the same street where the incident occurred, Roland and Shahzadi were able to obtain dismissal before even answering the complaint by timely obtaining work records and an affidavit from our client demonstrating that we did not perform work in the specific area where the accident occurred.  This proactive approach led to an immediate dismissal of the case against Bartlett’s client foreclosing any notion of indemnity payment and before the unnecessary expenditure of significant defense costs.
