Judge Ruth Kraft has just achieved a complete vindication of her client before the Workers’ Compensation Board. The Board sought to impose a $125,000 penalty for failure to maintain coverage as required. The client had argued that it had no covered employees during the period under review and was, therefore, exempt from the coverage obligation, to no avail. Judge Kraft framed the client’s case and supporting documentation in clear, cogent terms which supported rescission of the penalty in full. For small enterprises, penalties at the rate of $2,000 bi-weekly are draconian and can easily put them out of business. The grateful client wrote: “Good News. We won thanks to you. God Bless!”
