Plaintiff, a 71-year-old visitor to one of our hospital clients, was returning to her car in the visitor’s parking lot on a winter night when she tripped and fell over a parking bumper in a handicapped parking spot. She claimed that the lot was inadequately lit such that she was unable to see the bumper. She also claimed there were no warnings and no pedestrian path to cross the area without having to step over or around the parking bumpers. She sustained very serious injuries in the form of a fractured ulna with dislocation of the radius repaired by ORIF. No offer made. Notably, as the trial date approached, our client pulled the case from a competing firm that had handled it from inception and assigned it to Joe to take a verdict. No pressure! The jury adopted Joe’s arguments and quickly and unanimously found the property was reasonably safe resulting in a complete defense verdict. Congratulations, Joe!
