Double Shot of Success for Bartlett’s Appellate Practice Team

Robert G. Vizza obtained a successful result for Bartlett’s clients on appeal to the Appellate Division, Second Department. In Silver v Silver et al, 2018 NY Slip Op 04586, the Appellate Division affirmed a judgment in favor of the defendants dismissing plaintiff’s complaint on claims of unlawful imprisonment, intentional infliction of emotional distress, defamation, and violation of Civil Rights arising from involuntary psychiatric hospitalization.

Dave Zegarelli successfully argued the appeal obtaining a decision in Lorde v Margaret Tietz Nursing and Rehab. Ctr., 2018 NYSlipOp 04542, affirming the trial court’s order denying plaintiff’s motion for summary judgment under Labor Law §240(1) on the basis that the plaintiff failed to eliminate questions of fact as to whether the worker’s choice to stand on an inverted bucket, when the record demonstrated that there were ladders available on site, was the sole proximate cause of his injuries.
