Congratulations to the Bartlett LLP Florida Trial Team of Marybeth Cullinan, and Jorge L. Cruz-Bustillo for securing a directed verdict after a hard fought jury trial stemming from a Hurricane Irma property damage claim. In dismissing the case against Bartlett’s client, in its entirety, the trial Court adopted the argument of Marybeth and Jorge that “neither the Plaintiffs nor their expert were able to specifically establish that a covered peril first damaged the building thereby causing an opening in a roof or wall through which the rain entered.” As a result, the Court ruled: Plaintiffs shall take nothing by this action.
